LEVELUPThese Terms of Service govern your use of levelupskale.com and communications with LevelUpSkale. By using the website, requesting a Growth Audit or booking a call, you agree to these terms.
1. What we provide
LevelUpSkale provides marketing strategy, paid-media, conversion, landing-page and related client-acquisition services. A free Growth Audit is an initial discussion and high-level assessment; it is not a guaranteed diagnosis, formal audit report, legal advice, financial advice or a promise of future results.
2. No guaranteed outcomes
Marketing performance depends on many factors outside our control, including your offer, pricing, sales process, market conditions, competition, advertising platforms, website condition, budget, tracking quality and response speed. We do not guarantee rankings, leads, sales, revenue, ad approval, costs, return on ad spend or any particular outcome unless a separate written agreement expressly says otherwise.
3. Separate client agreements control paid work
Paid services begin only when both parties agree in writing to the scope, fees, payment schedule, deliverables, timelines and any specific conditions. A proposal, quotation, invoice or service agreement may include additional terms. If there is a conflict, the signed service agreement or accepted proposal controls for that engagement.
4. Your responsibilities
You confirm that information you provide is accurate, that you have authority to act for your business, and that your website, offers, claims, contact lists, advertising assets and data practices comply with applicable law and platform rules. You remain responsible for your business decisions, customer communications, pricing, fulfilment, approvals, taxes, advertising spend and access credentials.
5. Advertising platforms and third parties
Google, Meta, Calendly, Tally and other third-party providers operate independently and may change, suspend, reject or restrict accounts, campaigns, features or data access. We are not responsible for third-party outages, policy decisions, account reviews, platform charges or changes to their terms. Advertising spend is separate from LevelUpSkale fees unless explicitly stated otherwise in writing.
6. Intellectual property
LevelUpSkale retains ownership of its pre-existing frameworks, methods, templates, processes, tools and know-how. Once all applicable fees are paid, you may use final client-specific deliverables for your internal business purposes, subject to the agreed scope. You may not resell, reproduce, distribute or claim ownership of our underlying methods without written permission.
7. Acceptable website use
You must not misuse the website, attempt unauthorised access, interfere with its operation, submit unlawful or harmful material, impersonate another person or use automated means to extract data without permission. We may restrict access where reasonably necessary to protect the website, users or our business.
8. Limitation of liability
To the maximum extent permitted by law, LevelUpSkale will not be liable for indirect, incidental, special, consequential or punitive losses, including lost profits, revenue, data, goodwill or business opportunity. For a paid engagement, our total liability arising from that engagement will not exceed the fees actually paid to us for the specific service giving rise to the claim during the three months immediately before the event, except where liability cannot lawfully be limited.
9. Indemnity
You agree to protect and reimburse LevelUpSkale against claims, losses, liabilities, costs and reasonable legal expenses arising from material you provide, instructions you give, your business practices, your breach of these terms or your violation of applicable law or third-party rights.
10. Governing law and disputes
These terms are governed by the laws of India. Before starting formal proceedings, both parties will try in good faith to resolve a dispute by written discussion. Subject to applicable law, courts with jurisdiction over LevelUpSkale’s principal place of business will have exclusive jurisdiction.
11. Changes and contact
